Swas elected or polled not less than 6he-eighth of the total number - --'of-votes, counted at the election~, or -ied-before the close of the - poll on polling day. (3) For the purposes of this section the number of Votes. - polled shall be deemed to be the-number of ballot papers (other than rejected ballot papers and spoilt ballot papers) counted. (4-). Except :as otherwise provided in this section every, such deposit shall, at the expiration of one month from the conclusion Sof the election in respect of which it was made, be credited to general revenue. -25. If at the expiration of .three hours -from the time appointed there'shall be only one candidate duly nominated, the returning officer shall forthwith publicly declare such candidate to be, elected, and shall immediately-. thereafter certify by- endorsement on the writ of election in the, forn'set out-as Form -No. 27 in' the First Schedule-the teturnkof such candidate ana shall return the writ so endorsed to the Supervisor of Elections for transmission to the Governor within the time for that purpose specified therein. .26. (1) If 'there--shall be. more than one candidate duly nominated a poll of electors shall be taken,, and in such case the returning officer shall adjourn the election. to the day specified in -the'writ, and a ;p&11 shall be taken on-such- day in the, manner :.hereinafter provided. m (2) The returning-officer shall; as soon as practicable after adjourning the election,-give notice of the day and-time on which and" the addresses of the polling stations at which -the poll will be taken and of the names of the candidates nominated for election and of the place where and day and time when the number-of votes given to the several candidates- will 'be finally counted by publication thereof in-one or more newspapers; and. by causing notices to be posted at.such places in the district as he may deem necessary in the form setrout as Form.-No. 28 in the First Schedule. . 27. (1) .Where at anytime between the-issue of a writ-under subsection -(1) of section 20 of this Ordinance and. the day appointed by the writ for the holding of the poll at any election Sthe Governor is satisfied that it is.expedient so t6 do by reason of- S (a) His' Majesty's Governnent having become engaged or S being likely to become engaged in any war; or i(b) the proclamation of any state of emergency under any law S of the Colony for the time being in force; of .
