"No.7 of 1954. Virgin Islands Constitution 38 and lleetions, candidates in an electoral district for which one member is to be returned and not less than three duly nominated candidates in an electoral district for which two members are to be returned, (8) If any such candidate withdraws from his candidature in accordance with subsection (7) of this section, or dies before the day fixed for taking of the poll, the returning officer shall in the manner mentioned in subsection (9) of this seetion forth- with give publie notice ef such withdrawal or death; and all proceedings with reference to the election shall be commenced afresh in all respects as if the writ had been received on the day of such withdrawal or death, as the case may be, and the provisions of the preceding subsections of this section shall have effect accordingly ; ; Provided that no fresh nomination shall be necessary in the case of any candidate who has been ralidly nominated in accordance with sub- section (5) ‘of this section. (92) The notice meutioned in subsection (8) of this section shall be published. 52. (1) A candidate for election, or some- one on his behalf, shall deposit with the returning officer, on or before the day of his nomination, the sum of ninety-six collars, and, if he fails to do SO, the nomination of such “andidate shall be deamed to be withdrawn. (2) The deposit may be made in any legal tender, or, with the consent of the returning officer, in any other manner. (3) The full amount of every deposit made under subsection (1) of this section shall forthwith after its receipt be transmitted by the returning officer to the ‘Treasurer of the Presidency. (4) If after the deposit is made the candida- ture is withdrawn in accordance with the provisions of subsection (7) of section 51 the deposit shall be returned by the Treasurer of the Presidency to the person by whoi it was made; and if the candidate dies after the deposit is made and before the VIRGIN JSLANDS.
