Commissioner resign his seat on the Council. The seat of any such nominated member shall become vacant upon the acceptance of his resignation by the Governor, and the seat of an elected member shall become vacant upon the receipt of his resigna- tion by the Commissioner. (5) If any nominated member ef the Council shall be appointed temporarily to, or to act in, any public office, he shall not sit or vote in the Council by virtue of his appointment as a nominated mem- ber so long as he continues to hold, or to act in, that office. (6) Any person whose seat in the Council has become vacant may, if qualified, again be appointed or elected as a member of the Council from time to time. 13. The Council shall not be disqualitied for the transaction of business by reason of any vacancies in the membership of the said Council, including any vacancies not filled when the Council is first constituted or is reconstructed at any time; and any proceedings therein shall be valid notwith- standing that some person, who was not entitled to do so, sat or voted in the Council or otherwise took part in the proceedings. 14. (1) All questions which may arise as to the right of any person to be or remain a nomina- ted member of the Council shall be referred to and . be determined by the Governor. (2) All questions which may arise as to the right of any person to be or remain an elected member of the Council shall be referred to and determined by the Supreme Court in accordance with the provisions of any law in force in the Presidency. 15. (1) Whenever the seat of a nominated member of the Council becomes vacant the vacancy shall be filled by appointment by the Governor in accordance with the provisions of this Ordinance,
