(1) Subject to the provisions of section 11 the nominated members of the Council shall be British subjects of the age of twenty-one years or upwards and shall be appointed by the Governor by Instrument under the Public Seal of the Presidency. (2) The Governor shall forthwith report to Her Majesty through a Secretary of State every appointment of any person to be a nominated member of the Council. 7. The elected members of the Council shall be persons qualified for election in accordance with the provisions of, and elected in the manner pro- vided by, this Ordinance. 8. After the Cominissioner the members of the Council shall take precedence as Her Majesty may specially assign aud in default thereof as follows:— First, the official members according to the priority of the Instruments appointing them to be members or, if appointed by the same Instrument, according to the order in which they are named therein; secondly, persons temporarily appointed under Section 16 to fill vacancies in the number of persons sitting in the Council as official members in such order as the Governor may assign ; thirdly, the nominated and elected mem- bers according to the respective dates of the Instraments appointing them or upon which they were declared elected, as the case may be. If as regards two or more members other than official members such dates coincide, the members shall take precedence (a) in the case of two nominated members appointed by the same Instru- ment, in the order in which they are named therein; VIRGIN IsLANDs.
