Every person who steals, or, larceny. with intent to steal, cuts, breaks, roots up, or otherwise destroys or damages, the whole or any part of any tree, sapling, shrub, underwood, plant, root, fruit or vegetable production growing in any place whatsoever shall be guilty of felony, and on conviction thereof liable to be punished as in the case of simple larceny. (2) Where any person ‘is charged with an offence under subsection (1) of this sec- tion, such charge may be heard, tried and determined summarily by a. Magistrate and on conviction for any such offence the Magistrate may sentence the person charged to a fine not exceeding one hundred and twenty dollars or to imprisonment with hard labour for any term not exceeding six months, and upon a subsequent conviction on a similar charge, to a fine not exceed- ing two hundred and forty dollars or to imprisonment with hard labour for any term not exceeding twelve months.”.
