Section 3: jiUCTICITS AIiD DUTIES '7 FIELD AGE1YTS AIMD STAFF Si.PLOY"ES. a) It is the priiarj -urpose of field, agents to determine tlhe facts, to explain to persons subject to the Code their duties, their rights and obligations, and to atterxmpt by tact and persuasion to secure an nmicable adjustment of cohvplaints. In cases where re- spondent admits facts as alleged in a co.v)lr.int the field agent should obtain his explanation and a statement from him a.s to Vhat he will do to make restitution for violations admitted by himi. If re- spondent admits facts as alleged but trkes issue as to the application of the Code to these facts, the field -.gent shall obtain a clear explanation of the reasons for his position. If respondent denies facts, the field agent shall ask permission to examine records but if such -,permission is refused he shall not insist upon access to such records. Kle should, however, explain to respondent that hiis re- fusal will be an indication that he does not desire to adjust the complaint and will operate to his dis2.advantage. b) Before investigating an alleged violation, field a- gents shall notify respondent of the approximate date of r.rrival and the purpose of their visit. Employees should not be interviewed dur- ing working hours or upon the premises of the respondent unless per- mission to do so has been obtained from the latter. Field agents should bear in mind at all times that it is their function to find the facts and explain respondent' s obligations under the Code. They should not engage in argument or dispute. heir reports should be made only to the a1p)ropriate Comilaints Cor.mittee for further action. c) The Committees shall o)rr.tly advise the Code Auth- ority or its agencies of any cases in which persons subject to the Code have failed to permit field .agents of the committees to visit, examine, or otherwise investi-.-te conditions in any establishment operated by them, and the Code Authority and its agencies shall give a similar information to the Cormittees. Section 4: FIELD AGEFT'TS ?PER.TS. If a field agent reports that respondent has not violated any provisions of the Code, complainant will be so advised, and if no ' further word is received from him within a reasonable time the case shall be closed and the respondent so advised. If !.gent' s report in- 7 dicates that respondent is willing to comply and ma2l:e restitution for past violations, iuon satisfactory evidence that such action has "been takEen,' advice shall be given both to respondent and to comp-lainant and case s'_all be closed.
